Under Ukrainian legislation and the legislation of most countries in the world, copyright on a created work initially arises in its author (a specific programmer or designer). If the contract or acceptance-transfer act does not clearly specify the transfer of exclusive property rights to the client, the developer remains the legal owner of the code and may require prohibition of its use or additional payment. We draft contracts that on 100% protect the client's interests.
The "Diy.City" space provides leading tax conditions in Europe: profit tax 18% or capital withdrawal tax (CWT) 9%, VAT on income of gig specialists 5% instead of standard 18%, and military levy 1.5%. In addition, this is legal gig contracts instead of FOP schemes and official mechanisms against poaching (NCA/NDA).
If your website or application is oriented exclusively towards users in Ukraine, the Law of Ukraine "On Protection of Personal Data" applies. However, if your website is visited by citizens or residents of EU countries (for example, Ukrainian refugees abroad) or you accept European bank cards — the GDPR regulation applies extraterritorially, and the absence of a proper Privacy Policy and a consent mechanism for Cookies creates a real risk of payment gateways blocking or fines.
In Ukraine the standard procedure for registering a trademark takes from 12 to 20 months (accelerated — about 6–8 months). However, priority for your name and brand is established already from the moment of officially submitting a properly formatted application. For international protection we use the Madrid System or registration directly with EUIPO or USPTO.
A properly composed NDA agreement clearly defines what constitutes commercial confidential information, establishes procedures for recording the transfer of confidential data, and specifies significant penalty sanctions for breaches.
